Records you can see without asking

Everything on this website: the products and their prices, the features, the Terms of Sale, the Refund and Returns Policy, Delivery, the Privacy Policy, the Business details and this manual.

Records we keep because other laws ask for them

Among them: the Companies Act 71 of 2008; the Income Tax Act 58 of 1962 and the Tax Administration Act 28 of 2011; the Electronic Communications and Transactions Act 25 of 2002; the Consumer Protection Act 68 of 2008; POPIA and PAIA themselves; and the employment laws where the company employs staff.

The records we hold

The company: its registration documents and Memorandum of Incorporation, directors’ records and resolutions.

Money and tax: accounting records, invoices, bank records and tax returns.

Customers: orders and payments (through Payfast), licence keys and their computers, licence checks, support conversations, and messages sent through this website.

Agents: applications to become an agent, appointed agents’ details and approximate locations, and the purchases agents make for their Clients with the invoices issued to them.

Suppliers: agreements, invoices and contact details.

The software: EMTAC Digitising itself, its program code, fonts and documentation (confidential).

How we process personal information

Why: to sell and deliver licences, check them and offer updates; to give support; to assess agent applications and sell to appointed agents; to answer messages; to send messages from EMTAC inside the app (each one can be switched off); and to keep the records the law asks for. The Privacy Policy says what each of these uses.

Whose, and what: customers (name, e-mail address, billing details, licence key, a coded identifier of each computer, its internet address and approximate town, the app’s version, how long ago the app was used unless that is switched off, what they send to support, and when each of our support messages reached them and was read); agent applicants and agents (name, business name and registration number if given, e-mail address, mobile number, town and approximate location, what they do now, the areas they would serve, their purchases and invoices); the Clients of agents (name and e-mail address, given by the agent); people who write to us through this website (name, e-mail address, telephone if given, the message); suppliers (contact and banking details).

Who receives it: Payfast (payments); xneelo, in South Africa (our website, licence server and e-mail); GitHub (the app’s downloads and updates); our accountant; and the South African Revenue Service and other authorities where the law requires it.

Outside South Africa: the app and its updates are downloaded from GitHub, in the United States of America, which receives the downloading computer’s internet address. Everything else stays in South Africa.

How it is kept safe: encrypted connections for the website, the shop and the licence server; access only for the people who need it, with strong passwords and two-step sign-in where it is offered; keys that can read only what they must; encrypted backups. Card details never reach us: Payfast handles them.

How to ask for a record

Use the prescribed request form (Form 2 of the PAIA Regulations, on the Information Regulator’s website) and send it to the Information Officer at info@emtacdigitising.com or the address above, with proof of who you are. Say which record you want, how you want to receive it, and which of your rights the record is needed for.

The fees are those prescribed in the PAIA Regulations: a request fee, and an access fee for finding and copying the record. We tell you the fee before any work is done. We answer within 30 days; if a request needs longer, we tell you within those 30 days and may take up to 30 more, as PAIA allows. If we refuse, we give the reason and the part of PAIA it rests on.

Your own personal information: you may ask us, free of charge, to confirm whether we hold any about you, and ask for it (POPIA section 23), or for its correction or deletion (section 24) — see the Privacy Policy.

If you are not satisfied, you may complain to the Information Regulator, or apply to a court.
